Urheberrechtliche Vertrage Uber unbekannte Nutzungsarten und ihre AGB-Kontrolle

Since the so-called second basket came into effect on January 1, 2008, users of copyrighted works have also been granted the rights to those types of use that are still unknown when the contract is concluded. The importance of new types of use, such as forms of exploitation such as home video and DVD in the past, can hardly be overestimated for the future in view of the new media, such as the Internet and mobile communications, which have been developing faster and faster for over a decade. Against this background, this volume deals with the new legal requirements in 31a, 32c UrhG for an individual contractual granting of rights to unknown types of use. On the other hand, because of the outstanding importance of pre-formulated conditions in practice, the contracts for unknown types of use are also examined from the point of view of the GTC control.
