In recent years, the Department of Justice (DOJ) has scrutinized some Southern and Eastern state bars for noncompliance with the Americans With Disabilities Act. The DOJ has taken action against several state bars for imposing special conditions on licensure of individuals with past mental or substance issues-a form of second-class bar membership. As of 2015, however, the ADA is still not scrupulously observed in many states. The State Bar of Arizona has been violating the civil rights of members since at least 2004, when it hired a therapist –a man with a felony conviction record–to impose disciplinary counseling on members, both those with as well as many with NO prior mental health or substance history.
