Criminal law is characterized by evolutionary effects, justified by the concept of the forbidden which changes with time and society, the concern to protect the human being which is materialized by the creation of the international criminal court, and in the end criminality evolves and takes new forms against which it is necessary to fight.Cybercrime in the banking sector is a danger that threatens society in all its dimensions. Many banks admit to suffering substantial losses every year, so how can bank card piracy operations be punished under Congolese law? In order to combat this cross-border crime, the Congolese government introduced law n?18 /019 of July 09, 2018 on payment systems and securities settlement. In practice, this law has proved ineffective in prosecuting and punishing online bankcard hacking operations.
