The analytical concept of crime

The recent decisions of the Supreme Courts go against the grain of the neoconstitutionalist reconstruction of the law, and there is no obstacle to reading the criminal procedural norm as it was written, understanding a 'criminal fact' as a crime with all its integral elements - typicality, illegality and culpability - in respect for the fundamental principles of human dignity and the reasonable duration of the process.
