Justice in Tribunals

Justice in Tribunals is a successor to Disciplinary Tribunals. It is a specialist work on the common law and statutory principles which govern the disciplinary decisions of government departments, professional societies, commercial associations, trade unions, sporting bodies, social clubs and political parties. Covering the relevant private as well as public law, it explains the different procedures used to challenge statutory and private decisions respectively. This book goes well beyond the general principles of natural justice to examine many practical examples. They are arranged according to the various stages of a tribunal hearing - notice of the charge, legal representation, standard of proof, significance of the legal rules of evidence, procedure at the hearing and reasons for the decision. The law is stated as at 31 December 2001 and as such Forbes has been able to include a few later cases such as Kingham v Cole (February 2002, paragraph [17.16]). Kingham could well make substantial improvements to procedure and particularly to cross-examination in Royal Commissions and other public inquiries.Now with five updates from June 2003 to March 2005 - see Supplements.
