The Scottish Law Commission’s project on the law of trusts has been under way for some years, and has included the publication of a total of ten Discussion Papers and Consultation Papers, with two Reports on specific issues: first, on trustees’ powers and duties (a Joint Report with the Law Commission for England and Wales) and, secondly, on variation and termination of trusts. We have now reached the stage of a comprehensive Report and draft Bill. The latter is intended as a replacement for all existing trust legislation, other than that dealing specifically with charitable and public trusts. Charitable trusts are now governed by the Charities and Trustee Investment (Scotland) Act 2005; the result is that the law governing that area forms what is effectively a code of its own.
